Terms & Conditions

These terms govern your use of Forever Chat (the "Service"), provided by Legacy chat - Echoes of You ("we", "us", "our"). By creating an account or continuing to use the Service, you agree to these terms. You must be of legal age in your country, and if you accept on behalf of an organisation you confirm you have authority to bind it.

The Service

Forever Chat helps you record your stories, answers, voice and video recordings, photos and documents, and lets people you share an access code with have conversations grounded in what you recorded. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.

Your account

You must provide accurate information and keep it up to date, keep your password and legacy access code confidential, and you are responsible for activity under your account. You can reset your access code at any time, which immediately removes everyone who previously used it.

Acceptable use

You must not use the Service to:

• break any law, or infringe anyone's intellectual property or privacy rights;
• upload content you do not have the right to upload, or another person's likeness, voice or private information without their permission;
• send spam, impersonate others, or commit or facilitate fraud;
• upload malware, probe, scrape, overload or otherwise interfere with the security or integrity of the Service;
• reverse engineer the Service, resell or redistribute it, or work around technical limits.

Your content and AI responses

You keep ownership of everything you upload. You grant us a limited licence to host, process and display that content solely to operate the Service for you and the people you have given access to. The Service uses AI to organise your material and to compose replies based on it; responses are generated from your recorded answers and may be incomplete or inaccurate. They are not professional, medical, legal or financial advice, and should not be relied on as such. We may remove content or restrict features where content appears unlawful or in breach of these terms, and we act on good-faith complaints from rights holders, including terminating repeat infringers.

Intellectual property

We retain all ownership of the Service itself, including its software, design, documentation and branding. Nothing here transfers our intellectual property to you.

Payment and subscriptions

Subscriptions are $9.99 per month or $99.00 per year and renew automatically until cancelled. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms, together with our Refund Policy. Plan changes between monthly and yearly take effect at your next renewal.

Trials, freezing and deletion

New legacies include a free 1-month trial. If you do not subscribe by the end of the trial, or your subscription ends, your legacy becomes read-only. If it stays unpaid for 30 days after that, your legacy content is permanently deleted and cannot be recovered. Your account itself remains, and you can still take part in legacies you have been given access to. Subscribing before the deletion date restores everything.

Service levels

We work hard to keep the Service available, but we do not guarantee it will be uninterrupted, error-free or free of data loss. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Please keep your own copies of irreplaceable material.

Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may stop using the Service and delete your account at any time. On termination, access ends and content is deleted in line with the timelines above; contact us before then if you need an export.

Liability

To the fullest extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect, consequential or special damages, including lost profits, data or goodwill. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law. You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.

General

We may update these terms; material changes will be notified in the app or by email. You may not assign these terms without our consent; we may assign them in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of the seller's jurisdiction and disputes will be heard by its courts.
